Boating Accident Attorney on the Gulf Coast: What to Do If Your Day on the Water Goes Wrong
Summer on Mobile Bay is hard to beat. Boats, jet skis, Hobie Cats, the whole thing. David Greene from Greene & Phillips enjoys the water as much as anyone, and he stopped by Studio 10 recently to share a few things worth knowing before you head out — and what to do if a trip doesn’t go as planned.
If Something Happens, Call 911
Most people know to call 911 after a car accident. On the water, that instinct sometimes gets lost in the shuffle. People aren’t sure who to call, or they think they can sort it out on their own, so they exchange information and go home.
Alabama law actually requires that boating accidents involving injury, death, or significant property damage be reported. Getting Marine Police to the scene also creates an official record, which makes everything easier if an insurance claim comes into play later. Same rules as the road, really, just with better scenery.
Wear the Life Jacket
Greene was pretty direct about this one. The new generation of life jackets is a long way from the bulky orange blocks of the 1980s. They’re slim, comfortable, and not expensive. The Coast Guard requires at least one approved jacket per person on board, but wearing it is a different matter than having it on the boat.
On a jet ski or open boat, things can go sideways fast. A life jacket you’re actually wearing does a lot more good than one stowed under a seat.
Know What You’re Dealing With
Boating accidents can result in real injuries like fractures, head trauma, and in serious cases, much worse. Greene & Phillips has handled the full range over the years. The good news is that if another operator’s negligence caused the accident, their liability insurance is what covers your claim. You’re not coming after anyone personally. The at-fault boater’s policy pays, and if their coverage falls short, your own underinsured motorist coverage may pick up the difference, the same way it works after a car crash.
Get Someone in Your Corner Early
Insurance companies move quickly after accidents, and their adjusters know exactly what questions to ask. Having an attorney involved early means someone who knows the process is looking out for your interests while you focus on recovering. Evidence from the scene also fades fast, so the sooner you connect with someone, the better your position.
