Premises Liability: What Happens If You’re Injured on Someone Else’s Property?

Whether it’s a grocery store, an apartment complex, a neighbor’s house, or a business parking lot, property owners have a responsibility to keep their spaces safe. What exactly is premises liability?
Premises liability refers to a situation where someone is injured because a property owner didn’t take reasonable steps to keep their property safe. It could be something like a wet floor, uneven sidewalk, poor lighting, or even a broken handrail. If the hazard was known- or should have been known- and not fixed, the owner may be legally responsible.

What kinds of places does this apply to?
It can apply to all kinds of properties. Homes, businesses, apartment complexes, public buildings, and even private events. Whether you’re a customer, a guest, or a delivery driver, if you’re lawfully on the property, the owner has a duty to keep it reasonably safe.

What are some common mistakes people make after being injured on someone else’s property?
A lot of folks don’t report the incident right away or think their injury isn’t a big deal. Others fail to take pictures or get witness information. That can hurt your claim later. Also, talking to the insurance company without legal advice can lead to a quick, lowball settlement.

What steps should someone take if they’re injured due to unsafe conditions on a property?
First, get medical care. Then report the incident to the property owner or manager in writing. Take pictures of what caused your injury and gather names of any witnesses.
